Gifting properties in Dubai is a common practice for various purposes, such as inheritance or succession planning. It involves the voluntary transfer of property ownership without monetary exchange. The Dubai Land Department regulates property gifting and requires specific documentation for the process.
To gift a property, individuals must provide documents such as the owner’s title deed, a No Objection Certificate from the Developer, an evaluation certificate from the Dubai Land Department, and relevant personal documents like birth or marriage certificates. Companies, on the other hand, need to submit additional documents such as trade licenses, certificates of incorporation, and memorandum of association.
If a property has an existing mortgage, it is still possible to gift it. However, coordination with the bank is required, and additional fees, including mortgage release fees and re-registration fees, will apply.
It’s important to note that off-plan properties cannot be gifted unless they are still under a sales purchase agreement (SPA) with the developer and have not been registered with the Dubai Land Department.
One of the significant benefits of property gifting in Dubai is the reduced transfer fee. When gifting to first-degree relatives or companies, the transfer fee is only 0.125% of the property value instead of the standard 4% transfer fee. However, if gifting to siblings, the reduced transfer fee does not apply, and the regular 4% fee must be paid.
